Don't understand the problem.

The way you have set this out, I assume partner opened 2S. Why should I act?

If on the other hand you mean (2S) ?

Seems like a normal dbl to me - opening hand and a shortage. Yes I understand it's not ideal but I can't bear partner passing out his hand with some strength holding three spades or a lighter hand with shortage in spades which he can't double 2♠ or 3♠.

I wouldn't bebidding 2♥ over 1♠ with this hand - that could go for 800 or more - so 3♥ isn't on the radar. If we have a game on partner will say something. And if we miss a thin one I expect it'll be flat.
