I would have bid 4 before, but now I pass. Partner's double is penalties, not some weak t/o.

If the LOL's tank means she has a lot of HCP I pass on both occasions. Without the break in tempo I bid 4 and this double should be for penalties so I leave it. Maybe the LOL has diamonds among her hearts, we'll see.

Yes, the double of 4 is for penalties. I will probably leave it in, but partner might not have doubled if he knew I could have this hand.

The double is penalties, so that part of the question isn't interesting. I think I would have bid 4S the round before.
and the result can be plotted on a graph.

I might have bid the 1st round. 4 now is clear, as pard has some weakish 4441 or 5440.

By the way, did I tank over 4? This smells like a laws question ;)

I have 3 hearts and partner has a penalty double of 4 Hearts?
Doubtful.

Well, if this is a clear penalty double, I surely pass, I cannot have more defence.

If this is a late take-out with a weak 40(45), I try 4 Spade, what else?

If I have no idea what partner has, I would bid 4 , this is less expensive in case I err.

4 the first time - let the LOL have the last guess. Having passed, I'll still try 4. Partner could have AQT9 and out, but even then we might make it. Maybe I'm biased that the partners I play with are capable of doubling on a whim with heart shortness here.
