IF someone can show me a hand where this is NOT a penalty double, and it makes sense and also will not confuse partner, I will be impressed

Surprised there have been 10 threads on this, I think it must be penalty. It's not the same as an auction like 1S p 2S p p X where we have learned new information that may make coming in with a hand we would pass 1S with attractive.

Clearly penalty.
Though I've seen players mistake this as t/o. Normally their partner can diagnose this by looking at their own hand, but not always.

Thank you for the responses.
This came up in an ACBL game on BBO the other night. My partner made the double, which he intended as penalty. I did not recognize it (I guess I should have). When the smoke cleared, WE wound up playing in 3♠x.
My partner misplayed it a trick and had to settle for +730.
