If I understand this correctly it is legally a different thing to insult your spouse than to insult a random person. I don't see why.

Is it a criminal offense to say "you look ugly" to some random passerby? I don't think so. Therefore I don't think it should be a criminal offense to insult one's spouse either. We are not waiting for:

Prosecutor: "This guy insulted the victim who is his GF. We demand three months of jail!"
Defender: "She isn't his GF, it was just a casual thing!"

Once this monstrously ugly man married a good looking gal.

They were walking in the park and a passerby explains:

Looka here, the beauty and the beast.

Guy walks up to him and punches him.

How dare you call my wife a beast?

The most memorable incidents of spousal insults I have witnessed have been at the bridge table.

Many years ago, in the days when people still smoked cigarettes, a woman misplayed a hand against us and then said, "I really need a cigarette."

Her husband exploded, "Smoking cigarettes is what makes you so stupid."

My partner, a woman graduate student, took out a pack of cigarettes and offered it. Our opponent took one from the pack, put it into her mouth, and lit a match.

Her husband then said, "If you light that, I'll walk out of here and you will be barred for life by the ACBL."

"Go ahead," the wife replied, "you'll be the one barred. I'm staying right here. Playing bridge and smoking cigarettes are the only pleasures I get."

I can think of some reasons why it makes sense to distinguish them.

You usually care more about what your spouse thinks of you than what a random person says, so an insult from a spouse is more painful, and is likely to have a more lasting effect on your self esteem.

A pattern of verbal abuse may be more likely to escalate to domestic violence. Do we have to wait for someone to get physically hurt before interceding?

If a random insults you, you can walk away and probably won't see them again. You have to live with your spouse (unless the problem becomes acute enough to result in divorce).

"Doc, I am feeling awful, I don't know what's wrong."

"Your problem is that you're fat."

"That's your diagnosis? I want a second opinion"

"You want a second opinion? You're ugly."

Yeah, I know, it has whiskers. But it seemed appropriate.

This happened during a tournament in the Netherlands, playing against a married couple (my p Shogi is a computer geek):

Shogi: Do you have a CC?
Husband: No we just play "Papa and Mama Bridge"
Helene: Fair enough, we just play "Beauty and the Geek Bridge"
Shogi: Oh, who is beauty and who is the geek, then?

Yes. There's only one appropriate answer to "does this dress make me look fat?" And there are some questions that are traps, with no answer that won't get you in trouble.

Truth is only a defense against libel.
