After opening 1♠ (which is not automatic but is not objectionable), it is clear to pass over 3♣ and again over 3♦.
If I bid 3♥ now, I doubt that I will be able to play it there.
By the way, it is far from clear that 3♦ is going down. The opps are going to have to untangle the heart suit before they give up the lead (although there are some problems for declarer after a club lead and a trump shift).
I don't have any problem with partner's 2♦ bid. A two level bid in competition is not the same as a 2 over 1.

I don't think that ben or i intimated this to be the case. The hand is still not good enough for 2D.

I would bid 2♦ over 2♣. I think getting your (decent) suit involved in competitive auctions are crucial. But of course I plan on rebidding 3♦ if I get the chance next which would be NF for me. And no, I don't intend the 2♦ as a NFB.
