I think this is a pretty good hand for a penalty pass though. The spade length doesn't seem like a deterrent -- you might just tap out declarer and he'll lose control. I think I would pass for sure w/r, and I'd be awfully tempted to do so at equal vul as well.

Of couse having a way to show a
in between hand, would be great,
the hearts values are positioned right
and i have Acess, this should be enough
compensation for the missing HCP and
the poor shape.
Since I am a passed hand, partner wont
take 3H to serious.

Lol, this eurothing is great when travelling, less good twhen they pay prices in dollars
3NT is another option. 2NT/3♥ is the normal bid, 2♠ is a big underbid IMO after the overcall.

Uh, a sterile 5-2-3-3 hand with xx in hearts is an automatic double imo. Justin already commented that pass won't guarantee playing 2H doubled but when they are red that isn't a big problem.

This hand has too much potential to pass - we can miss a game. Therefore I will bid 2NT.

1♠ can be light opening (3rd/4th seat). So why is 2♠ an underbid.
4333 shape and 10hcp and not knowing if pd opened light or sound--Who wants to bid anything other than 2♠ now? Pass is another good option and probably better than 2♠ since you dont even know if he opened with 4 or 5♠.
I am sure 2way drury guys know what i am talking about.
