It depends on who partner is, if you can say that parter doesn't even have a King for his pass over 4 with shortness then I guess pass is right, otherwise it is not right in my opinion.

I would never pass this hand, but as the only reasonable alternative is 5, pass is a pretty good pesimistic bid.

Oh, we're vul and they are NV? Then definitely 5. I initially read the other way about when passing might be worth considering.

I think you're not allowed to change an insufficient bid to a X (at least in the ACBL). Correct me if I'm wrong somebody.

I meant that if they accepted my 3N and the 4 bidder bid 4 again, then I could double for penalty. It does seem you can't correct an insufficient bid to X or XX - only pass or a bid.
