To provide the Department of Justice the necessary authority to apprehend, prosecute, and convict individuals committing animal enterprise terror. (added comment: WTF???)

IN THE SENATE OF THE UNITED STATES
October 27, 2005

A BILL

To provide the Department of Justice the necessary authority to apprehend, prosecute, and convict individuals committing animal enterprise terror (added comment: WTF??????)
`(a) Offense- Whoever travels in interstate or foreign commerce, or uses or causes to be used the mail or any facility of interstate or foreign commerce--

(added comment: any facility of interstate or foreign commerce - like the internet, right?)

`(1) for the purpose of damaging or disrupting an animal enterprise; and

`(2) in connection with such purpose--

`(A) intentionally damages, disrupts, or causes the loss of any property (including animals or records) used by the animal enterprise, or any property of a person or entity having a connection to, relationship with, or transactions with the animal enterprise; (added comment: in other words, don't post anything negative on your blog about the loud, foul-smelling, flea-riddin pitbull kennel next door if you don't want the Feds knockin' down your door.)

`(B) intentionally places a person in reasonable fear of the death of, or serious bodily injury to that person, a member of the immediate family (as defined in section 115) of that person, or a spouse or intimate partner of that person by a course of conduct involving threats, acts of vandalism, property damage, trespass, harassment, or intimidation; or

`© conspires or attempts to do so;

(b) Penalties-

`(1) ECONOMIC DAMAGE- Any person who, in the course of a violation of subsection (a) causes economic damage not exceeding $10,000 shall be fined under this title or imprisoned not more than 1 year, or both.

`(2) SIGNIFICANT ECONOMIC DAMAGE OR ECONOMIC DISRUPTION- Any person who, in the course of a violation of subsection (a), causes economic damage or economic disruption exceeding $10,000 but not exceeding $100,000 shall be fined under this title or imprisoned not more than 5 years, or both.

`(3) MAJOR ECONOMIC DAMAGE OR ECONOMIC DISRUPTION- Any person who, in the course of a violation of subsection (a), causes economic damage or economic disruption exceeding $100,000 shall be fined under this title or imprisoned not more than 10 years, or both"

Six members of Stop Huntingdon Animal Cruelty (SHAC), a radical animal rights group, have been sentenced to between one and six years in prison by a federal jury in Trenton, New Jersey,

SHAC targeted HLS and other companies doing business with HLS by posting on its Web site the names, addresses, phone numbers and other personal information of HLS employees and those who do business with the company.

(added comment: Now there's some serious criminal activity - posting on a Web site.)

The defendants (dubbed the “SHAC 7” by supporters before charges against another man were dismissed) were convicted in March for conspiracy to violate the Animal Enterprise Protection Act. (added comment: WTF?????????????and we wonder why there is prison overpopulation.)


Boy, do I feel safer now. Thank God al-Quada won't be able to "dis" Arnold the Pig without some serious repurcussions. I wonder if badmouthing Kentucky Fried Chicken in this post would be worth 5 years in the slammer.

Or is that still part of free speech?

You are right. They are now $1000 a plate fundraisers - Guess there really isn't such thing as a "free lunch" - or free speech.
