What hand might I hold with which I'd want to make a balancing takeout double over 4 after failing to make a direct one over 3?

This is all I see that's close, but it's not the same situation. Unless we were told that the fix is upcoming in Version 31...

I clearly remember being told that GIB would no longer try for game opposite balancing doubles by hands that had previously passed.

This isn't quite the same because we are already at game level, but the point is that GIB would recognize that the doubler is limited by having passed.

My question is: Why shouldn't this be a penalty double, since I could have made a takeout double last round if I had wanted to?

My thought, you didn't know that LHO was going to raise. If you are good enough now to double 4D for penalty, you probably would have bid 3NT or something else the first time.

Reckoning that you have 5 defensive tricks against a diamond contract is quite a far cry from guessing that you have 9 offensive tricks in NT opposite a passing partner.Sure, there will be some overlap.

And you only need 4 defensive tricks to set 4.

I had thought of that. I think that you need 5 to double it. You may not be able to count on all of them as certain, and doubling for one off is not going to make you rich,
